RENTAL AGREEMENT (100125-r16)
Your Reservation and Payment Confirms that You (Guest) have read, understood, and agree to All Terms and Conditions of this Agreement.
RENTAL RULES AND REGULATIONS:
THIS AGREEMENT WILL BE VALID UPON YOUR RESERVED ARRIVAL DATE AND END ON YOUR RESERVED DEPARTURE DATE.
Forest Cabin at Sinking Creek (home) address: 182 Thrash Rock Road, London, KY 40741.
The owner/s (we/us) agrees the home & property are in good condition and upon check-in or during their stay, the guest (you) will immediately notify the owner of any deficiencies or waive any objections to same.
Owner rents the subject property under the following conditions:
1. TWO PERSONS MAXIMUM. CHECK-IN TIME IS AFTER 3 pm ET AND CHECK-OUT TIME IS BY 11 am ET. Early check-in/late check-out is subject to an additional fee and must be approved, in advance, by the owner.
2. This is a NON-SMOKING home. Please do not smoke inside. Smoking is permitted outside only, please use ashtrays provided, please do not dispose of your cigarette butts on the ground.
3. NO PETS, Pets or service animals are not permitted in rental unit under any conditions, due to allergy, health, and safety concerns.
4. No students or singles under 25 years of age shall occupy the subject home unless accompanied by an adult guardian or parent.
5. NO DAMAGE OR THEFT - Owner requires the following provisions to be met under this Agreement:
a. No damage is done to the home, its contents, and the property, beyond normal wear and tear. Do not remove anything. Leave everything as found, where found. Leave No Trace.
b. No charges are incurred due to contraband, pets, or collection of rents or services rendered during the stay.
c. All debris, rubbish & discards are placed in or by the trash can. There are extra bags in the drawer. Full bags may be placed in the green trash bin next door if needed.
d. Soiled dishes and all cooking items including BBQ Grill are clean, dry, and put away before departure. Leave everything as found, where found.
e. The key is left on the kitchen counter and all windows are closed and latched and the exterior door is locked. A twenty-five-dollar ($25.00) fee will be charged for a lost key.
f. All charges accrued during the stay are paid before departure.
g. No linens or other home items are lost, damaged, or removed. Any damage/loss must be reported to the Owner.
h. Nothing is to be taken from the home or property including plants, trees, or any other item.
6. CLEANING FEE- Please leave the cabin and all items as found, where found.
7. PAYMENT – The total rent payment must be received upon booking the reservation. Bookings are via website agency unless other payment arrangements have been made with the Owner. This rent payment is not a damage deposit.
8. CANCELLATIONS – Guests who cancel at least 14 days before check-in will get back 100% of the rental amount. If canceled between 7 and 14 days before check-in, 50% of the reservation fee is refunded. Cancellation 7 days or less before check-in date or early departure for any reason does not warrant any refund of rent.
9. It is advised that the guest take out a comprehensive policy of insurance covering their interest in the premises including their possessions and insure against any liability for personal or public risk. The guest acknowledges that he/she has been advised by the owner to arrange adequate personal insurance coverage for all members of his/her party to cover all travel, personal risks, injuries and liabilities, and any cancellation.
10. MAXIMUM OCCUPANCY - The maximum number of guests is limited to two (2) persons. An additional charge of $10.00 per person per night for guests in addition to two (2) will be assessed and must be authorized in writing at the time of booking.
11. NO PARTIES ARE ALLOWED IN THE RENTAL. This includes any use of the rental that causes it to be occupied by more than 6 people. Use of the premises and common areas in such a fashion that disturbs the peace or damages property shall be deemed grounds for immediate eviction.
12. INCLUSIVE FEES – Rates include a one-time linen-towel set-up. NO DAILY MAID SERVICE-While an initial supply of linens and towels is included in the home rental, daily maid service is not included in the rental rate.
13. PARKING – Parking is limited to two (2) licensed and registered vehicles. Vehicles are to be parked in designated parking areas only. Parking on the road is not permitted. Any illegally parked cars are subject to towing; applicable fines/ towing fees are the sole responsibility of the vehicle owner. Please make prior arrangements with the owner for any additional vehicles, campers, trailers, motor homes, or boats being parked overnight.
14. STORM POLICY/ROAD CONDITIONS – No refunds will be given for storms or power outages. We do not refund due to weather or road conditions. To protect against cancellations caused by unforeseeable events such as illness or bad weather, we recommend that guests purchase trip cancellation insurance from a private carrier.
15. Our home is privately owned; the owners are not responsible for any accidents, injuries, or illness that occurs while on the premises or its grounds. The owners are not responsible for the loss of personal belongings or valuables of the guest. By booking this reservation, it is agreed that all guests are expressly assuming all risk of any harm arising from their use of the premises.
16. The property adjoins the Daniel Boone National Forest, and you are subject to all National Forest rules while here. Guest also understands that this area is a rugged semi-wilderness area and that insects not limited to ticks, chiggers, deerflies, spiders, rodents, amphibians, reptiles, and snakes including copperheads, chipmunk, squirrel, rabbit, coyote, fox, bobcat, turkey, deer, bear, etc. flourish in this environment. Keep outside doors closed at all times. We recommend leaving wildlife alone. Approach wildlife at your own risk. Fly swatters & insect spray are provided. Please notify owners immediately about any pest problem that requires remediation. Although the owner will use its best efforts to hold to a minimum your interaction with any pests during your stay, the guest understands that any contact by a guest with such a pest within or outside the unit does not constitute a breach of this Agreement or give Guest any right to any refund or rental adjustment.
17. Access DBNF from our property at the northwest boundary. The terrain is rugged & steep with many cliffs and dropoffs. Please be safe while hiking, wear good shoes, watch where you are going, holes, cliffs drop-offs are possible. Be cautious. Branches/trees may fall at any time, whether or not they appear dead, even when there is no wind, and can be dangerous. Be aware of snapping from tree roots, trunks, or branches (know that sometimes there is no sound and very little time to react). Report falling branches, trees, and any dangerous conditions to the owner. Rocks may tumble from above you or slip from below your feet. Watch for potential hazards while you are out exploring the woods.
18. Any issue that the guest has with the property shall be immediately reported to the owner at 606-312-6226. Guest understands that the owner shall have a reasonable amount of time to restore the home to acceptable conditions and that any issues presented to the owner by the guest not preventing reasonable and habitable occupancy of the home shall not constitute a breach of this Agreement nor give the guest any right to any refund or rental adjustment. Any towels or bedding provided by us may not be allergen-free, if this is a concern, please provide your own bedding and towels with no refund or rental adjustment.
19. Leave the home and property as you have found it. Before checkout, please place any used towels in the closet basket, or on shower floor. Please don't make the bed. Extra paper towels, and supplies are located on the shelf in the closet. An iron & ironing board can be provided upon request. Our home has a septic system. Flush only toilet paper, please do not put food, grease, hygiene items, or other waste down the drain, please do not dump any oil, cooking grease, food waste, or any other items in the yard, please put in the trash. Read and follow all the Home Rules regarding the use of any amenities in the home and public areas (yard, grill, etc.) as detailed in this agreement.
20. Low-speed 1.5 mg+/- but unlimited rural internet is provided, if you need fast internet, be prepared to provide your own. TV, DVD, telescope, books, DVDs, games, etc. are provided. Please leave all items intact and in the same way you have found them for our next guests (as found, where found). Cell service may be spotty, Verizon is best.
21. We have tried to think of everything you will need while here, except food. We supply ground coffee, decaf instant, cocoa, assorted teas, salt, pepper & assorted spices in the cabinet for your use while here. Cookware, tableware & appliances, coffeemaker, tea kettle, blender, can opener, and a gas grill is provided for use while here. At checkout, please leave all items as found and where found. If you need anything, please do not hesitate to contact us.
22. FIREPIT: Fires are allowed in the firepit only, wood is provided. You may gather kindling or use the newspaper provided in the closet. Check weather.gov, KY EPA or DBNF website to be sure there are no fire advisories. If it's windy, DO NOT have a fire. Attend the fire at all times. NEVER LEAVE THE FIRE UNATTENDED. Extinguish all burning embers with the hose. If freezing weather, leave the hose detached. DO NOT BRING YOUR OWN FIREWOOD OR USE ANY FIREWOOD NOT OBTAINED ON THE PROPERTY. NOTE: Fire Hazard Season Restrictions are as follows: Oct. 1 – Dec. 15 and Feb. 15 – Apr. 30: Burning within 150 feet of any woodland or brushland area is allowed only in the evening hours between 6 pm and 6 am. 23. No ATVs or ORVs, firearms, hunting, shooting, or fireworks of any kind are permitted on the property at any time and are cause for immediate cancellation & eviction.

25. Please note that we have only this vacation home in the Daniel Boone National Forest and cannot easily write off lost income from cancellations. If you are concerned about the possibility of a last-minute cancellation or early departure, we strongly suggest that you take responsibility for this risk and obtain trip cancellation/interruption insurance. You understand that your choice not to insure your vacation is your responsibility.
26. A valid government-issued photo ID such as a driver's license or passport will be required at check-in. Please provideany cell phone numbers to contact you during your stay.
27. Any exceptions to this agreement must be agreed to by the owner at the time of booking or your reservation will be canceled without notice or refund.
28. This rental agreement is made in Laurel County KY and its terms shall be enforced only in Laurel County KY at the sole discretion of the owner.
29. Upon default, the guest agrees to pay all costs of collection including attorneys’ fees of the owner.
This Agreement is valid for the guest’s RESERVED ARRIVAL DATE after 3:00 pm through the guest’s RESERVED DEPARTURE DATE before 11:00 am.
Guest agrees to occupy the home on the arrival date reserved no earlier than 3:00 pm and depart the home no later than 11:00 am on the departure date reserved and leave the home and property as you have found it.
Any changes to this agreement must be made in writing and agreed to in advance by the owner. The owner reserves the right to retain any payments in the event of any changes, if not notified at the time of booking.
PLEASE ENSURE ALL PROVISIONS ARE MET. YOU AGREE TO PAY ANY DAMAGE FEES.
THE OWNER CONFIRMS YOUR RESERVATION FOR THE PERIOD BOOKED WHEN THE RENT IS PAID IN FULL.
